These Terms & Conditions (“Terms”) constitute a legally binding agreement between Iksha (“Company”, “we”, “us”) and the user or entity (“Customer”, “you”) accessing or using Iksha services.

1. Acceptance of Terms

By accessing or using Iksha services, including GPS tracking, fleet management, IoT devices, APIs, dashboards, or mobile applications, you agree to be bound by these Terms and our Privacy Policy.

2. Nature of Service

Iksha provides technology-based services including real-time GPS tracking, telemetry monitoring, analytics, and fleet intelligence systems. Services are dependent on third-party infrastructure such as telecom networks, GPS satellites, and device hardware.

3. No Guarantee of Continuous Accuracy

  • GPS data may be affected by environmental conditions, network coverage, or hardware limitations.
  • Iksha does not guarantee uninterrupted or error-free tracking.
  • Data is provided “as is” for operational reference only.

4. Customer Responsibility

  • You confirm you have lawful authority to track all vehicles/assets registered under your account.
  • You are solely responsible for compliance with applicable labor, transport, and privacy laws governing driver/employee tracking.
  • Misuse of tracking for unlawful surveillance is strictly prohibited.

5. Data Ownership & Usage

  • Customer retains ownership of raw operational data generated from devices.
  • Iksha may process, aggregate, and anonymize data for analytics, improvement, and system optimization.
  • We do not sell personal data to third parties.

6. Account Security

You are responsible for maintaining confidentiality of credentials. Any activity under your account shall be deemed authorized unless proven otherwise.

7. Third-Party Dependency Disclaimer

Services rely on third-party providers (telecom, cloud, maps, hardware). Iksha is not liable for disruptions caused by such providers.

8. Limitation of Liability

To the maximum extent permitted under Indian law:

  • Iksha shall not be liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid by you in the preceding 3 months of service.

9. Suspension & Termination

We reserve the right to suspend or terminate services without prior notice in cases of:

  • Fraud or illegal activity
  • Non-payment
  • Violation of these Terms

10. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.

11. Amendments

We reserve the right to update these Terms at any time. Continued use of services constitutes acceptance of revised Terms.
